Please read these Terms of Service carefully before using Loyal & Loved (“we,” “us,” or “our”) at loyalandloved.com (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Loyal & Loved is a pet memorial writing service. We use artificial intelligence to generate personalized literary tributes for companion animals based on information you provide. Our services include written tributes, memorial pages, downloadable PDFs, and related deliverables depending on the tier purchased.

2. Eligibility

You must be at least 18 years old to use this Service and place an order. By using the Service, you represent that you meet this requirement.

3. Purchases and Payment

All purchases are processed securely through Stripe. Prices are displayed in US dollars. By completing a purchase, you authorize us to charge the amount shown at checkout to your payment method. Taxes may apply depending on your jurisdiction.

We offer three one-time purchase tiers:

• The Tribute ($9):A personalized literary tribute and shareable memorial page.
• Essential ($19):The Tribute plus a print-ready PDF, tone variants, and a digital keepsake card.
• Legacy Collection ($49):Everything in Essential plus a long-form life story, AI painterly portrait, and a letter written in your pet’s voice.

4. Delivery

Your tribute will be generated and delivered within minutes of payment confirmation. A link to your memorial page will be emailed to the address you provide at checkout. Legacy Collection deliverables beyond the initial tribute may be delivered within 24 hours of purchase.

5. Our Guarantee

We stand behind the quality of every tribute we write. If you are not moved by what we’ve created, we will rewrite it at no additional charge. To request a rewrite, email us at hello@loyalandloved.com within 30 days of purchase with the name of your pet and what you’d like changed or improved.

6. Refunds

Because our service involves the immediate generation of a custom creative work, we do not offer monetary refunds after delivery. Our commitment is to rewrite your tribute until it is right. Please see our Refund Policy for full details.

7. Your Content

When you use our Service, you provide us with information about your pet (their name, personality, history, and your memories). You retain all rights to this information. By submitting it, you grant us a limited license to use it solely for the purpose of generating your tribute. We will never sell or share your personal information or pet information with third parties for marketing purposes.

8. Our Content

The tribute we generate for you is yours to use, share, print, and keep. You may share it freely on social media, in print, or with family and friends. You may not resell tributes as your own creative work or represent AI-generated content as human-authored without disclosure.

9. Intellectual Property

The Loyal & Loved name, logo, website design, and all original content we create are our intellectual property. You may not reproduce, distribute, or create derivative works from our website content without written permission, except as necessary to share your own purchased tribute.

10. Limitation of Liability

To the fullest extent permitted by law, Loyal & Loved shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid for the service in question.

We do not guarantee that generated content will meet any specific emotional standard beyond our rewrite commitment. AI-generated writing reflects the information provided and the inherent capabilities and limitations of the technology.

11. Third-Party Services

We use the following third-party services to deliver our Service: Stripe (payments), Supabase (data storage), Anthropic (AI generation), Resend (email delivery), and Vercel (hosting). Your use of our Service is also subject to their respective terms and privacy policies.

12. Modifications to Terms

We may update these Terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
